Purchasing from the Nest

  •  If you, or any member of your household are self isolating, have tested positive for, or are suffering from Covid-19  please wait for 14 days after full recovery before purchasing from the Nest, (as in the event you wish to Return the item, there will be potential delay to Refund timescales).
  • Sadly, due to the impact of the pandemic on transit time, overseas shipping is currently suspended.
  • Dispatch of the item may be delayed by up to 24 hours from purchase date.
  • Though delivery services are making every effort to meet Next Day Delivery timescales, this is not currently guaranteed.
  • On receipt of your parcel, please immediately wipe down exterior and then quarantine in a secure indoor space for a minimum of 12 hours before opening. Do not leave your item on the doorstep or outside due to theft and damage risk.
  • On unpacking, please examine the item thoroughly to ensure satisfaction.
  • Do not apply any cleaning or care products to the item until the Security Tag is removed.

Returns

  • If you wish to the Return an item, please carefully repack as soon as is possible, using original tissue wrap and seal the outer box, ready for dispatch.
  • If you, or any member of your household are self isolating, test positive for the virus or developed symptoms during the period in which you have received your purchase, please advise me via email and special Extended Return Instructions will be provided.
  • On receipt of the item the exterior of the parcel will be wiped down with an Antiviral Surface Cleanser and then quarantined in a secure, indoor store room for a minimum of 24 hours before being opened.
  • When unpacked, all internal packaging will be disposed of.
  • The item will then be thorough re-cleansed with Leather Wipes and left to stand for 12 hours.
  • Refunds will be processed by the Nest within 48 hours of receipt via the original payment method though please remember some payment providers can take up to 14 days to pass your funds back to your account.
  • Refunds are less original Postage Cost.
  • The Nest does not charge any fees for Returns however Paypal charge you 3% of the original transaction amount. The Nest is currently subsidising this to 2% for clients.

All other aspects of the Nest's Terms & Conditions below remain unchanged.

1.    Definitions

1.1 The "Buyer" means the person who buys or agrees to buy Item(s) from the Seller.

1.2 The "Seller" means Naughtipidgins Nest Ltd (abbreviated to NPN Bags for the purposes of this document)

1.3 The "Sender'" means the individual sending Item/s to NPN Bags for resale purposes.

1.4 "Service(s)" means the provision of services to Buyers or Senders by NPN Bags.

1.5 "Contract" means the defined Service agreement between Buyers, Senders and NPN Bags.

1.6 "Conditions" means the conditions of sale set out in this document and any special conditions agreed in writing by the Seller.

1.7 "Item" means the physical goods subject to sale via NPN Bags. 

1.8 “Receipt of Item " means the point at which the item is Signed-For on delivery (this does not have to be by the named individual on the invoice)

1.9 "Acceptance of Item" means the point at which the Buyer provides written confirmation they intend to keep the item or 14 days from Receipt of Item, whichever comes first.

1.10 "Delivery Charge' means the inclusive cost to ship an item.

1.11 "Closed Periods" means any duration of time that NPN Bags is not providing Services.

1.12  'Sale items' means items that are notated to have been reduced from original listed price on NPN Bags.

1.13 'Website' means www.npnbags.co.uk and/or www.naughtipidginsnest.co.uk

1.14 "NPNP" means Naughtipidgins Nest Passport - a document for the Buyer, providing information on the item purchased.

1.15 "PayPal" means the Financial Payment Service (inclusive of all Card Payments)

1.16" Faster Payments" means the instantaneous Bank Transfer of funds.

 

2. Conditions

2.1 These "Terms and Conditions" do not affect your statutory rights as a consumer.

2.2 The Terms and Conditions set out in this document shall prevail over any other communication from the Sender or Buyer if not agreed in writing by NPN Bags prior to Contract.

2.4 Receipt of email confirmation of Terms & Conditions by the Buyer or Sender shall be deemed conclusive evidence of full acceptance.

2.5 All Services offered by NPN Bags is an invitation only. NPN Bags retains the right to refuse Services and cancel Contracts to both Senders and Buyers at its discretion.

 

3. Warranty and Liability

3.1 All items are sold 'As Is' and therefore no warranty is given or implied. Items sold described as in a 'New' condition or 'As New' are remain under the classification of pre-owned and whilst may still be under manufacturer’s warranty, it is the Buyers responsibility to confirm any warranty period prior to contract and that warranty remains with the manufacturer, not NPN Bags.

3.2 NPN Bags accepts no liability at any time for defects or issues arising after Buyer acceptance, at any time. Under no circumstances shall NPN Bags be liable for any indirect, incidental or consequential damage and any personal injury related to the item at any time is entirely at the buyers own risk. 

3.3. Where available, original or copies of receipts will be advertised and can be requested by the Buyer, 14 days after Receipt of Item. Any documentation advertised does not form part of the condition of sale at any time.

3.4 Documentation / Receipt request must be made within 6 months of item receipt. After this time, documentation cannot be provided.

3.5 While every effort is made to ensure that the item descriptions are accurate, the nature of the goods will lend to personal interpretation.

 

4.  Prices

4.1 Prices on the website are displayed in £ GBP and exclude Delivery Charges unless Free P&P is stated.

4.2 The total purchase price, including any Delivery Charges will be displayed on the website at Checkout.

4.3 Prices and Delivery Charges are non-negotiable.

4.4 Payment must be made in full before dispatch of any goods and provision of payment does not form a binding contract of sale (see 2.5 above)

4.5 Payment committed via Faster Payments must be received within 10 minutes of order placement or item will be relisted on the website and made available for general purchase.

 

5. Delivery

5.1 All parcels will be shipped via a fully insured, tracked and signed for shipping service within 7 days of payment receipt.

5.2 Items will usually be dispatched within 1-2 working days from cleared payment being received, unless requested otherwise, (however all items must be shipped within 7 days of payment receipt).

5.3 Whilst every reasonable effort shall be made to accommodate specific delivery dates, the Seller shall not be liable for any expenses incurred by the Buyer or any other person or Company arising directly or indirectly out of any failure to meet any estimated delivery date.

5.4 Items purchased via PayPal can only be addressed as per Payment Transaction received by NPN Bags, under conditions shown in 5.1 above.

5.5 Items purchased via Faster Payments may be addressed as per Buyers request, under conditions shown in 5.1 above.

5.8 Information and tracking details will be provided to the Buyer within 12 hours of item dispatch.

 

6. Non Receipt

6.1 In the event of the non-receipt of an item, the Buyer should inform NPN Bags of the non-delivery within 7 working days for UK buyers, and 15 working days for international buyers, from the date NPN Bags dispatched the item. After 15 working days for UK buyers, and 21 working days for international buyers, if the item has still failed to arrive, and the tracking does not indicate its arrival, the Buyer will have the option for a full refund inclusive of Delivery cost.

6.2 Deliveries by Courier have the facility to be rearranged by a period of up to 5 days. If an item is not collected or redelivery accepted within this time frame, the item will be returned to NPN Bags. The Buyer will be liable for the outgoing postage cost plus a surcharge of £15.00 (which is charged to NPN Bags by the Courier Company). 

6.3 In the event of any item being returned to NPN Bags due to the above, the Buyer will receive the option of a refund (less outward Delivery Charge and Courier Charge if applicable). If re-delivery is required, the Buyer will be responsible for the cost of the re delivery and Courier Charge (if applicable), before the item is dispatched again.

 

7. Customs

7.1 All Items shipped outside of the UK will have the final purchase amount declared as contents value, as per their enclosed invoice documentation.

7.2 Any Import Duty due is payable by the Buyer directly to the levying Local Government Department. Amounts due are not the responsibility of NPN Bags.

6.1 Items returned to NPN Bags due to Customs Fees Not Paid will be refunded less all costs incurred to NPN Bags, inclusive of Delivery Charge and a £50 Administration Fee. Please note, NPN Bags provides 50% of this Fee to the Sender as compensation for loss of marketing exposure whilst the item has not be available for sale on the website.

 

8.  Ownership & Risk

8.1 Ownership of Items remains with the Sender until the Item Acceptance by the Buyer, (see 1.9 above)

8.2 NPN Bags provides Item insurance cover for loss or damage whilst in NPN Bags physical possession. Items are insured to their current agreed resale price, translating to the corresponding financial value to the Sender dependent on % commission rate agreed at Contract. An administration charge of 10% is levied on this compensation to cover the cost of any insurance claim.

8.3 Responsibility for any Item outside of NPN Bags physical premises transfers to the Deliver Carrier until the Buyer Accepts goods received.

8.4 The Buyer shall inspect the goods within 24 hours of receipt and if the goods are assessed not acceptable due to damage or defect the Buyer must contact NPN Bags in writing within 48hours of receipt. If the Buyer fails to report any damage or defect during this period they are deemed to have Accepted the goods in the condition received and ownership of the item passes to them.

8.5 Any Item in respect of which any claim of defect or damage is made shall be preserved by the Buyer intact together with the original packaging and accompaniments. Photographic evidence of damage or defect may be requested by the Seller and if so, must be provided before permission to Return will be provided.

8.6 If a Return is agreed by the Seller, the Buyer must Return the Item, (following all written instructions set out by NPN Bags) for inspection within 24 hours of notification, at their own risk.

8.7 Item and accompaniments must be received by NPN Bags within 7 working days of Sellers instruction to Return.

8.8 On receipt and inspection, if appropriate, a full refund inclusive of all postal costs incurred will be issued to the Buyer via original payment method.

8.9 If the Security Tag has been removed at any time, the item is non-refundable.

 

9. Cancellation

9.1 Cancellation instruction from the Buyer must be received by NPN Bags in writing and may take place up to the point at which the Item is dispatched. 

9.2 The Nest does not charge any fees for Cancellations however payments made via Credit or Debit Card are subject to a 3% fee, deducted by PayPal. The Nest is currently subsidising this to 2% for clients.

9.3 Once an item has been dispatched, a Cancellation of sale follows the process of a Return, (see 10 below).

 

10.  Returns

10.1 Buyers retain the right to Return an Item within 14 days of Receipt (see 1.8 above), (excluding under conditions 8.4 above).

10.2 If a Return is required the Buyer is requested to notify NPN Bags in writing within 14 days of Receipt and prior to the item being sent back. Return Instructions and address will be provided within 12 hours of notification and these must be adhered to in full in order for a Refund to be issued.

10.3 Items must be returned in the same condition as dispatched, with all associated packaging and accompaniments in situ, (ie if Store Tags were attached these much not have been removed). 

10.4 The sealed NPN Bags Security Tag must be in place to be eligible for a refund. Any item returned without this Tag intact will not be refunded.

10.5 Please note Returns will not be accepted from a Smoking environment, or if the item has acquired any aroma not previously present.

10.6 Items must be returned within 14 calendar days of Receipt (2 days if a Sale Item, politely requested), excepting over the Xmas period where the Returns Period may be extended by an additional number of days at the discretion of NPN Bags. The Buyer must adhere to the conditions set out in the publicised 'Extended Returns Policy' as per seasonal website information, in order to qualify.

10.7 The Buyer should return via a fully insured, trackable method. The tracking number should be provided to NPN Bags within 12 hours of dispatch.

10.8. Items returned from overseas must be marked as 'Returned Merchandise'. Any Customs Fees incurred by NPN Bags to receive a Returned Item will be deducted from the Refund.

10.9 The Buyer will be liable for the cost of return delivery to NPN Bags. 

10.10 Upon receipt of the returned Item and successful inspection, NPN Bags will refund the Buyer by the same method as per original payment, excluding Delivery Charge.

10.11 A Payment Processing Fee of 2% of Total Invoice Amount (inclusive of Delivery Charge) will be deducted from Refunds processed via Paypal (which includes Credit & Debit Card Payments). No fees apply to items purchased via Faster Payments.

10.12 If the Item is returned in a differing condition to that sent, NPN Bags reserves the right to withhold all or part of the refund. A deduction may be made for loss in value of any Item supplied, if the loss is the result of unnecessary handling by you or if is damaged in return transit due to inadequate packaging or shipping mishandling. An exchange or credit may be issued at the discretion of NPN Bags.

10.13 Refunds will usually be processed by NPN Bags on the day of receipt however please note, in some circumstances Banks and Credit Providers may take up to 14 days to return funds to Buyers Accounts. NPN Bags has no control over 3rd Party Refund timings.

 

11. Consignment Service

11.1 The Consignment Service offered is at the discretion of NPN Bags Ltd. No assurance is given that an item accepted will sell at the price proposed, at a reduced price, or at all.

11.2 Initial Resale prices proposed are on the basis of full disclosure of the items condition, (including aroma) and accompaniments.

11.3 The item should be sent to NPN Bags within 7 calendar days of email acceptance, securely protected, boxed and via an insured, trackable postal method.

11.4. If the item is not received within 7 calendar days of email acceptance, NPN Bags reserves the right to refuse services.

11.5 By sending an item to NPN Bags the Sender is confirming that:

  1. they are over 16 years of age.
  2. the rightful owner of the item and/or if the item is being sold on anothers behalf the Sender has the owners permission to sell as if their own
  3. the item is not stolen or under hire/ subject to any financial agreement
  4. the item may be lawfully sold to consumers without restriction
  5. the item is as-described and from a non-smoking environment.

11.6 If the items condition on receipt, varies from expected, then NPN Bags reserves the right to amend the proposed Resale price appropriately. If the proposed Resale price is not acceptable to the Sender then the item will be returned to the Sender by fully insured, trackable shipping. The cost of return shipping must be borne by the Sender prior to return. NPN Bags will not be liable for any return Delivery Charge, nor costs incurred.

11.7 In the unlikely event that an item received is deemed to be non-authentic, it will be disposed of and not returned to the Sender. It is a criminal offence to place counterfeit items into the postal service.

11.8 The date of email acceptance of the proposed Resale Price constitutes a Sole Marketing Agreement with NPN Bags for a period of 30 weeks from that date, (excluding Closed Periods, see website for current details).

11.9 If the proposed resale price is confirmed as not acceptable by the Sender, the item will be returned to the Sender on provision of Special Delivery Cost.

11.10 If an email response is not received from the Sender within 7 calendar days of proposition of Resale Price then NPN Bags assumes acceptance of Contract and will proceed to market the item on the website as per price proposed.

11.11 NPN Bags will endeavour to ensure Listing date is within 7 days of receipt of item, however during busy periods this cannot be guaranteed.

11.12 The Sender may request the return of the item at any time during Contract at which point the % Commission Charge based on the items current List Price plus Delivery Charge will be due, prior to the return of the item.

11.13 Items may be returned to the Sender at any time at the instigation of NPN Bags. If the return is instigated by NPN Bags prior to end of 30 week Contract, then the cost will be borne by NPN Bags. After 30 weeks, (excluding Closed Periods) the item may be returned to the Sender. All costs for return must be borne by the Sender.

11.14 Once marketed, control over the listed price remains with NPN Bags. Senders may request amendments but alterations to price are at the discretion of NPN Bags.

11.15 If the item has not sold within 20 weeks, (excluding Closed Periods) of first listing date, then Sender or NPN Bags may suggest a price reduction or alternative marketing approach. The Sender has the right to refuse a price reduction for a period of 30 weeks, (excluding Closed Periods) from listing date. If a sale is not achieved within 30 weeks, (excluding Closed Periods) and a price reduction is not agreed the item may be returned to the Sender at their own cost.

11.16 If a reduction is agreed by the Sender, the reduction will be actioned for the period of the Sale, as advertised. Unless further communication is received, this price will be maintained and not reverted, after the Sale period.

11.17 If a Sale reduction is not agreed, the Senders financial return remains as initially agreed at the contract outset.

11.18 After 30 weeks, if the item remains unsold, any outstanding amounts owed by the Sender to NPN Bags must be settled prior to items being returned, inclusive of costs to return the item.

11.19 When a sale is achieved and the item Received by the Buyer, the funds are held in escrow by NPN Bags for a period of 14 days.

11.20 A Sender will be notified as to a successful sale at the end of the 14 day period and funds transferred to their nominated bank account (or PayPal account if requested) (excepting during Extended Returns Period over Xmas and during Closed Periods where this is extended by an additional 7-14 days).

11.21 Sellers not holding a UK Stirling Account will receive funds via PayPal which will be subject to PayPal's standard fees.

11.22 The Sender will receive a fixed % of the Sale price as agreed with the Sender at the outset.

11.23 NPN Bags service commission level is discretionary based on items price, desirability and condition. Average commission is 25% of the items sale price up to £300, 20% from £301 to £3,000, 15% for £3,001 to £6,000 and 10% above £6,001, inclusive of all deductions and fees, (with exception of PayPal payments, see 11.21 above)

11.26 Whilst the item remains the property of the Sender until the Buyer Accepts ownership, any photographic images or text created by NPN Bags in relation to the item, remains the Sole property of NPN Bags Ltd and cannot be assigned, reproduced or recreated for any commercial purpose.

 

12. Part-Exchange Service

12.1 A Part Exchange Service is offered at the discretion of NPN Bags and may not be available during some periods throughout the year.

12.2 Initial part-exchange prices proposed are on the basis of full disclosure of the items condition, (including aroma) and accompaniments.

12.3 The item should be sent to NPN Bags within 7 calendar days of email acceptance, securely boxed and via an insured, trackable postal method.

12.4 By sending an item to NPN Bags the Sender is confirming that:

  1. they are over 16 years of age.
  2. the rightful owner of the item and/or if the item is being sold on anothers behalf the Sender has the owners permission to sell as if their own
  3. the item is not stolen or under hire/ subject to any financial agreement
  4. the item may be lawfully sold to consumers without restriction
  5. the item is as-described and from a non-smoking environment.

12.5 If the items condition on receipt, varies from expected, then NPN Bags reserves the right to amend the proposed part-ex price appropriately. If the proposed part-ex price is not acceptable to the Sender then the item will be returned to the Sender by fully insured, trackable shipping. Delivery Charge must be borne by the Sender prior to return. NPN Bags will not be liable for any return postage costs nor costs incurred.

12.6 If an email response is not received from the Sender within 7 calendar days of confirmation of part-ex price then NPN Bags assumes an acceptance of a Consignment contract and will proceed to market the item on the website as per a Consignment Sale (all subsequent T&C's relating to Section 11 above will apply)

12.7 The balance of payment due (by either party) to finalise the Part-Exchange will then be due within 12 hours of email confirmation. The item will remain available for sale on the website until funds have been received by NPN Bags.

12.8 Part Exchange transactions within Mainland UK benefit from Free Standard Special Delivery Charge, (not inclusive of Premium Services, eg weekend).

12.9 If the Part Exchanged item is to be returned the Returns Process should be adhered to in full, (see Section 10 above) however a refund will be provided until the Senders original item has successfully concluded a Sale.

12.10 Items sent as Part Exchange against another item which is subsequently Returned are non-returnable to the original Sender. Any balance due to the Sender will be reduced to the 'Direct Buy' price, (see 13 below). NPN Bags reserves the right to return Part-Exchanges at their discretion and postage costs will then be borne by NPN Bags.

 

13. Direct Buy Service

13.1 A Direct Buy Service is offered at the discretion of NPN Bags and may not be available during some periods throughout the year.

13.2 Initial price(s) proposed are on the basis of full disclosure of the items condition, (including aroma) and accompaniments.

13.3 The item should be sent to NPN Bags within 7 calendar days of email acceptance, securely boxed and via an insured, trackable postal method.

13.4 By sending an item to NPN Bags the Sender is confirming that:

  1. they are over 16 years of age.
  2. the rightful owner of the item and/or if the item is being sold on anothers behalf the Sender has the owners permission to sell as if their own
  3. the item is not stolen or under hire/ subject to any financial agreement
  4. the item may be lawfully sold to consumers without restriction
  5. the item is as-described and from a non-smoking environment.

13.5 If the items condition on receipt, varies from expected, then NPN Bags reserves the right to amend the proposed Buy Price appropriately. If the proposed Buy Price is not acceptable to the Sender then the item will be returned to the Sender by fully insured, trackable post. The cost of return Delivery Charge must be borne by the Sender prior to return. NPN Bags will not be liable for any return postage costs nor costs incurred. 

13.6 If an email response is not received from the Sender within 7 calendar days of confirmation of Buy Price then NPN Bags assumes an acceptance of a Consignment contract and will proceed to market the item on the website as per a Consignment Sale (all subsequent T&C's relating to Section 11 above will apply)

13.7 All payments are sent to Senders within 24 hours of agreed price and can be provided by Bank Transfer, Cheque or PayPal, (subject to PayPals standard fee deductions). Overseas Senders will receive payment via PayPal (subject to PayPals standard fee deductions).

 

14. Gift Vouchers

  1. NPN Bags Gift Vouchers are non-refundable.
  2. Vouchers are redeemable against multiple items in a single transaction only.
  3. No change or credit will be issued.
  4. Unique Voucher codes are redeemable only once and will not be reissued. NPN Bags accepts no liability for codes redeemed without permission of the original purchaser.
  5. Refunds for purchases or part-purchases made with Gift Vouchers will be issued in Gift Vouchers and via original payment method.
  6. Vouchers have no cash in value at any time.

 

15. Force Majeure

In the event that the Seller is prevented from delivering its Services as a result of any cause beyond its control such as, but not limited to, Acts of God, War, Strikes, Lockdowns, Illness or Injury, NPN Bags shall be relieved of its obligations and liabilities to Senders & Buyers for as long as such fulfilment is prevented.

15.1 NPN Bags retains the right to suspend all or part of its Services for any reason, at any time and for any duration.

 

16. Copyright Statement

You may download, display, print, post and reproduce material from NPN Bags in unaltered form only (retaining this notice) for your personal and non-commercial use, (eg; information sharing, opinion gathering and authentication requests). Reproduction of material for commercial use is not-permitted, inclusive of Terms & Conditions content

 

17. Disclaimer

NPN Bags is not an authorised dealer of, nor in any way affiliated with, any of the Designers, Brands or Manufacturers whose products appear on the website. All product trademarks, brand names, and logos are provided for identification purposes only and are owned by the Brands & their Agents without exception. NPN Bags does not claim any rights therein.

 

18. Data Protection / Privacy Policy

18.1 All information collected by NPN Bags is the sole property of such. NPN Bags will not share or sell this information with anyone.

18.2 Information retained will only be - your name, address, email, phone number, items sold and purchased and Returns made. 

18.3 No marketing activity is undertaken with any information retained

18.4 No Customer Data is shared with any 3rd parties.

18.5 All Data is held securely and in compliance with the EU General Data Protection Regulation. NPN Bags do not see or hold any financial information on this site and no Credit or Debit card details are stored by NPN Bags.

18.6 You may ask for any of your details to be removed at any time by contacting NPN Bags directly.
